Terms of Service.

PLEASE READ THESE TERMS CAREFULLY. BY ENROLLING IN OR USING MOXY’S TENANTSHIELD SUBSCRIPTION, YOU (“TENANT,” “YOU,” OR “CUSTOMER”) AGREE TO BE BOUND BY THEM.

  1. DEFINITIONS  

    1. “Moxy,” “we,” “our,” or “us” means Moxy RPS Pty Ltd (ABN 56 665 660 917).  

    2. “Premises” means the residential property you lawfully occupy under a lease agreement.  

    3. “Quarterly Clean” means the limited cleaning service performed once per calendar quarter before a scheduled routine inspection by the property agent.  

    4. “Bond Clean” (also called an “End-of-Lease Clean”) means the comprehensive cleaning service performed once, after you have removed all personal belongings and before you return possession of the Premises to the agent/landlord.  

    5. “Subscription Fee” means the weekly amount payable under clause 5.  

    6. “Term” means the period beginning on the Subscription Start Date and ending upon the earlier of (a) termination under clause 10 or (b) the end of your lease (including any extension).  

  2. SERVICES INCLUDED  

    1. Quarterly Cleans  

      1. Scope: 

        1. Mould and soap scum removal in bathrooms, showers, sinks and vanities

        2. Fans, airconditioning filters, and vents throughout the Premises

        3. Tracks on all windows and sliding doors

        4. Full oven and rangehood clean 

      2. Timing: One service in each three-month cycle. You must request your preferred date at least 14 days before the inspection.  

    2. Bond Clean  

      1. Scope: A full bond clean in line with the Residential Tenancies Act guidelines for your state, including ovens, rangehoods, inside cupboards, interior windows, walls (spot), skirting, fans, and floors. Carpet steam cleaning and pest treatment are excluded unless purchased separately.  

      2. Timing: You must schedule the Bond Clean at least seven (7) days before vacating and ensure utilities (power, hot water) remain connected until completion.  

      3. Exclusions:  The detailed exclusions and terms of bond cleaning services is outlined in ‘Moxy’s Bond cleaning T&Cs’ available at www.moxy.au.

  3. CUSTOMER RESPONSIBILITIES  

    1. Access: You must provide safe, unimpeded access to the Premises on the confirmed service date, including parking if available.  

    2. Condition: Premises must be in a hygienic and safe state. We may refuse service where biohazards, pests, or illegal substances are present and charge a call-out fee.  

    3. Valuables and Fragile Items: Secure or remove valuables, confidential documents, and fragile items.  

    4. Utilities: Electricity, hot water, and running water must be available during any service.  

    5. Inspection Dates: You are responsible for notifying Moxy of inspection dates and ensuring the Quarterly Clean is scheduled accordingly.  

  4. SERVICE MODIFICATIONS & RESCHEDULING  

    1. You may reschedule a service once, free of charge, by giving at least 48 hours’ written notice. Less than 48 hours’ notice may incur a $50 rescheduling fee at Moxy’s sole discretion.  

    2. If we must reschedule due to circumstances beyond our control (e.g., extreme weather, staff illness), we will offer the next available slot at no additional charge.

  5. FEES & PAYMENT  

    1. Subscription Fee  

      1. You agree to pay the Subscription Fee associated with your selected options during your service sign-up for the first 12 months. The Subscription Fee is reduced to 35% from month 13 until termination.

    2. Billing Cycle: The Subscription Fee is billed weekly to the payment method you provide. You authorise us to charge your chosen payment method for the Subscription Fee 

    3. Failed Payments: If a charge is declined, you must update payment details within five (5) days. Overdue amounts attract interest at 5% p.a. calculated daily.  

    4. Additional Services: Work outside the scope of clause 2 is charged at our then-current rates and must be paid prior to commencement.

  6. PRICE CHANGES  

    1. We may change the Subscription Fee after the Minimum Term (12 months) by giving at least 30 days’ written notice. You may terminate under clause 10.1.2 if you do not accept the change.

  7. QUALITY GUARANTEE  

    1. If you believe a service was not performed with reasonable care and skill, notify us in writing within 48 hours with photos.  

    2. Our sole obligation is to re-clean the disputed area within a reasonable time. This guarantee does not apply where the issue results from circumstances beyond our control (e.g., new damage caused by occupants after the service).

  8. HEALTH & SAFETY  

    1. We comply with relevant workplace health and safety laws.  

    2. You must inform us of any known hazards (e.g., loose power points, aggressive pets). Pets must be secured during the service.

  9. LIMITATION OF LIABILITY  

    1. To the fullest extent permitted by law, Moxy’s total cumulative liability arising under or in connection with these Terms (whether in contract, tort, negligence, statute, or otherwise) is limited to the Subscription Fees you paid in the three (3) months preceding the event giving rise to the claim.  

    2. We are not liable for indirect or consequential loss, loss of rent, or loss of bond where the property agent’s standards exceed normal industry practice.  

    3. Nothing in this clause limits liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be limited by law.

  10. TERM, CANCELLATION & TERMINATION  

    1. You may cancel:  

      1. At any time after the Minimum Term by giving 30 days’ written notice; or  

      2. Within the Minimum Term if we materially breach these Terms and fail to remedy within 14 days of notice, or if we increase prices under clause 6.  

    2. We may terminate immediately if:  

      1. You fail to pay fees within 14 days of due date;  

      2. You breach clause 3 and do not remedy within seven (7) days; or  

      3. We cease to provide the Subscription in your area (with pro-rata refund of prepaid fees).  

    3. Effect of Termination: If termination occurs before the end of the lease term and therefore prior to the final bond clean, we will refund the account balance (amount deposited minus value of services provided to that date) less a 20% administration fee.

    4. Any accrued rights, the Limitation of Liability clause, and any clauses which by their nature survive termination will remain in force.

  11. FORCE MAJEURE  

    1. Neither party is liable for delay or failure to perform obligations (other than payment) caused by events beyond reasonable control, including natural disasters, pandemic restrictions, or government orders.

  12. PRIVACY  

    1. We collect and handle personal information in accordance with our Privacy Policy (available at moxy.au/privacy). By subscribing, you consent to that collection and use, including contacting you about service reminders and promotions.

  13. INTELLECTUAL PROPERTY  

    1. All trademarks, content, and materials provided by Moxy remain our property. You may not reproduce or distribute them without prior written consent.

  14. ASSIGNMENT  

    1. You may not assign or transfer your subscription or rights under these Terms without our prior written consent. We may assign our rights and obligations on written notice.

  15. NOTICES  

    1. Notices must be in writing and sent by email to the addresses on file. Notices are taken to be received when the sender’s system records transmission, unless returned undelivered.

  16. ENTIRE AGREEMENT & AMENDMENT  

    1. These Terms, together with any Service Confirmation and our Privacy Policy, constitute the entire agreement. We may amend these Terms by giving 30 days’ written notice. Continued use after the effective date constitutes acceptance.

  17. SEVERABILITY  

    1. If any provision is held invalid or unenforceable, it will be severed and the remainder of the Terms will remain in force.

  18. GOVERNING LAW

    1. These Terms and Conditions will be governed by and construed in accordance with the laws of the State of Queensland, Australia.
