ABOUT THIS POLICY  

This Privacy Policy explains how Moxy Cleaning Services Pty Ltd (ABN 39 655 612 785) and Moxy RPS Pty Ltd (ABN 56 665 660 917) (“Moxy”, “we”, “our”, “us”) collects, uses, discloses and safeguards Personal Information received from:  

    1. Tenants who subscribe to our residential cleaning services (“Customers”); and  

    2. Real-estate agents, property managers or landlords who engage with us in relation to those services (“Agents”).  

It is drafted to comply with the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). If you are located in another jurisdiction, we will also comply with any mandatory local requirements applicable to your Personal Information.

We rely on the following legal bases (where relevant): performance of a contract (APP 6.2(a)), your consent (APP 6.1), our legitimate interests in operating and improving our business, and compliance with legal obligations.

  1. DEFINITIONS  

    1. “Personal Information” means information or an opinion about an identified individual, or an individual who is reasonably identifiable.  

    2. “Sensitive Information” includes information about your health, criminal history or membership of a professional or trade association. We generally do not collect Sensitive Information; if we ever need it we will ask for your explicit consent.  

    3. “Services” means our subscription-based quarterly and bond cleaning services and any related products or support.

  2. INFORMATION WE COLLECT  

    1. Information you give us  

      1. Identity details – name, date of birth (optional), driver licence or passport number (if required for key collection).  

      2. Contact details – residential address, e-mail, phone, emergency contact.  

      3. Property information – tenancy dates, routine-inspection schedule, access instructions, alarm or lock codes, photos or videos you upload.  

      4. Billing information – payment card details (processed via an accredited payment gateway), bank details and billing address.  

      5. Communications – e-mails, online chat, phone recordings, surveys, feedback and claims.  

      6. Agent details – agency name, business address, licence number and contact details.  

    2. Information we collect automatically  

      1. Device & usage data – IP address, browser type, device identifiers, log files, pages visited and the date/time of each request.  

      2. Cookie data – see section 11.  

      3. Service metrics – job completion times, GPS location of our field staff while on-site (for scheduling and proof-of-service).

    3. Information we receive from third parties  

      1. Property managers or landlords may confirm inspection dates or bond-clean requirements.  

      2. Payment providers may supply fraud-prevention data or payment-status updates.  

      3. Marketing partners may supply lead-generation information where you have consented to that disclosure.  

  3. HOW WE USE PERSONAL INFORMATION  

    1. We use Personal Information to:  

      1. deliver, schedule and verify the Services you request;  

      2. identify you, manage your account and process payments;  

      3. communicate with you and/or your Agent about upcoming cleans, changes or issues;  

      4. respond to enquiries, complaints, warranty or insurance claims;  

      5. conduct customer-satisfaction surveys, promotions and direct-marketing campaigns (see section 10);  

      6. improve and develop new products, services and features;  

      7. maintain business records, comply with laws, detect fraud and protect our legal rights; and  

      8. facilitate a sale, merger, financing, assignment or other disposition of all or part of our business, subject to confidentiality safeguards.

  4. DISCLOSURE OF PERSONAL INFORMATION 

    We disclose Personal Information only for the purposes set out in section 3, to:  

    1. Our employees and vetted subcontracted cleaners who require the information to perform the Services.  

    2. Third-party service providers such as payment processors, IT hosting, route-optimisation platforms, SMS gateways, insurers and professional advisers.  

    3. Your nominated Agent/landlord to confirm job completion or resolve a cleaning dispute.  

    4. Government authorities, regulators or law-enforcement agencies where required or authorised by law.  

    5. A purchaser of our business or assets, subject to confidentiality and only to the extent permitted by law.

    6. We do not sell or rent Personal Information for unrelated third-party marketing.

  5. INTERNATIONAL DATA TRANSFERS

    1. Some cloud or technical providers we use are located outside Australia (currently in the United States, the EU and Singapore). Where we transfer Personal Information overseas, we take reasonable steps to ensure the recipient protects it to standards that are overall comparable with Australian privacy law, for example through contract terms or certification schemes.

  6. DATA SECURITY & RETENTION  

    1. Security measures include TLS encryption in transit, ISO-27001 certified data-centres, role-based access, two-factor authentication and regular security assessments.  

    2. Physical keys or alarm codes provided to us are stored in encrypted form and deleted once no longer required.  

    3. We retain Personal Information for as long as required to deliver the Services, comply with legal and tax obligations, resolve disputes and enforce our agreements. When no longer needed, it is securely destroyed or de-identified.

  7. ACCESS & CORRECTION 

    You may request access to, or correction of, Personal Information we hold about you by emailing privacy@moxy.au. We will respond within 30 days. If we refuse access/ correction as permitted by law, we will explain the reasons and how you can complain.

  8. YOUR CHOICES  

    1. You can update your account details by contacting us on hello@moxy.au or via phone at (07) 5430 0825.  

    2. Marketing: You may opt out of e-mail or SMS marketing at any time by clicking “unsubscribe” or texting “STOP”, or by contacting us. Service-related notices are not marketing and will continue while your subscription is active.  

    3. Cookies: See section 11 for opt-out options.  

    4. You may cancel your subscription under our Terms & Conditions; however, we may still need to retain certain records for compliance.

  9. COOKIES & ANALYTICS

    1.   We use first-party and third-party cookies and similar technologies to:  

    1. keep you signed in and remember preferences;  

    2. measure site performance and improve content;  

    3. deliver targeted advertising on platforms such as Google Ads or Facebook (only where permitted).  

    4. You can disable non-essential cookies via our cookie banner or your browser settings. Some site features may not function correctly without cookies.

  10. THIRD-PARTY LINKS

    1. Our website or app may contain links to external sites we do not control. We are not responsible for their privacy practices. Review the privacy policies of any site you visit.

  11. CHILDREN  

    1. Our Services are not directed to children under 18. We do not knowingly collect Personal Information from children. If you believe we have unintentionally received such information, contact us so we can delete it.

  12. CHANGES TO THIS POLICY 

    1. We may amend this Privacy Policy from time to time. We will post the updated version on our website and, for material changes, give at least 14 days’ notice via e-mail or in-app message. Your continued use of the Services after the effective date constitutes acceptance of the revised Policy.
